Your privacy is of the utmost importance to us here at SmallVerse. At all times we will endeavor to protect your right to privacy, and only use any personal information you submit to us, for the purpose it was originally intended for.

The following policy describes how we treat personal information that we collect and receive, including information related to your use of the SmallVerse service. Personal information is information about you that is personally identifiable like your name, email address, or date of birth, and that is not otherwise publicly available.

If we make any significant changes to the privacy policy, we will notify you via email or by placing a prominent notice on our site and within the SmallVerse entry process.

2. Information Collection

SmallVerse collects personal information when you register with us, when you use the SmallVerse service, and when you visit SmallVerse website pages or the pages of some of our partners. We may combine information about you that we have with information we obtain from business partners or other companies. We generally use this information to improve the relevance and quality of our service.

When you register we ask for information such as your name, email address, date of birth etc. We use this information to allow you to log into the SmallVerse service, and to contact you for important communications regarding the SmallVerse service. You can opt out of these communications at any time.

SmallVerse collects information about your transactions with us and with some of our business partners.

SmallVerse will never store credit card information or other sensitive payment details. When you choose to "save this card" during our payment process, our bank stores the information in their secure systems.

Our server logs automatically record information from your browser, including your IP address, browser cookie information, and the pages you request. Cookies are small text files placed in your web browser to remember your preferences, and are generally used to determine how many visitors we get and what parts of our website and service they visit.

SmallVerse does not currently accept registrations from children of the age of 12 or under.

3. Information Sharing

SmallVerse will not disclose any personal information about you to any third parties without your permission, except under the following circumstances:

• We provide information to trusted partners who work on behalf of or with SmallVerse under confidentiality agreements. These companies will only use this information in context to their relationship with SmallVerse, and will not be allowed to use it for their own independent purposes.
• We are required by law to divulge the information, or in the process of exercising our legal rights or to defend against legal claims. We may also share information in order to prevent or arrest any illegal activities, violations of SmallVerse's Terms Of Service, or any other activity that may threaten the safety or security of any person.
• We may transfer or merge information if we are acquired by, or merged with, another company.

These Terms and Conditions of Sale govern your purchases of products and services from SmallVerse on SmallVerse.app ("site") (however accessed and/or used, whether via personal computers, mobile devices (i.e., purchases via SMS) or otherwise). Every time you make a purchase on our site, you acknowledge and accept these Terms and Conditions of Sale. Every order you place through SmallVerse or through our vendors will be deemed your offer to purchase. We may accept your offer either through an e-mail confirmation or through provision of the products you ordered. Our acceptance of each offer as specified is expressly subject to and conditioned on your acceptance of these (and only these) Terms and Conditions of Sale.

1. SmallVerse Gold and VIP Club Membership

Purchases of SmallVerse Gold or VIP Club subscriptions are purchases of a limited, non-transferable, revocable license. The license may be terminated immediately if your account is terminated for any reason, in SmallVerse's sole and absolute discretion, or if SmallVerse discontinues providing the services on the site. SmallVerse Gold and VIP Club Membership subscriptions and any other items sold on the site have no monetary value, are non-refundable and cannot be used to purchase or use products or services other than in-game play offered by SmallVerse.

Where SmallVerse Gold and VIP Club Membership subscriptions are purchased via mobile services, the SmallVerse Gold and VIP Club Membership subscriptions are not redeemable for content or services offered by the carrier. You have no property interest in SmallVerse Gold, VIP Club Membership subscriptions, your avatars, or your virtual items, which remain the exclusive property of SmallVerse subject only to your limited, non-transferable revocable license to use such for in-game play subject to our Terms of Service and these Terms of Sale.

Any attempt to sell or transfer these items will result in an automatic termination of such license. Further, as these are merely licensed game play activities, they are deemed consumed upon purchase in the same way as putting a coin into an arcade game machine and terminate upon any termination of your account.

2. Billing and Payment

You (together with your legal guardian if you are under eighteen (18) years of age) are solely responsible for setting up payment limits and otherwise configuring the account settings of the billing payment method associated with the VIP Club Membership subscription or SmallVerse Gold purchase. You represent and warrant to SmallVerse that you are authorized to use the billing payment method (including, without limitation, all accounts, credit cards and such associated therewith) for the purposes of purchasing VIP Club Membership or SmallVerse Gold as described herein.

3. Cancellation and Refunds

If you have agreed on a fixed term for your VIP Club Membership subscription, you further agree that the subscription will not be cancelled prior to the expiry of the agreed fixed term. All SmallVerse Gold and VIP Club purchases are non-refundable, except in our sole and absolute discretion or as required by applicable law.

4. Prices and Tax

All prices shown on this Site are subject to change without notice. Prices stated in the confirmation page of the order process apply to your order. Applicable taxes are not included in the product prices, but all such charges will be added to your invoice and will be visible during the purchasing process, before you complete your transaction.

We will collect sales tax in the states and countries we are required by law to do so. Thus we may require you to tell us your state or country of residency when ordering. Applicable sales tax will be added to your purchase.

5. Credit Card Security

SmallVerse is committed to the security of your personal information and of your online transactions. Please see our Privacy Policy to understand how we take care of your personal information. Our servers protect your information using encryption and firewall technology throughout the ordering process. Our transaction process uses the Secure Sockets Layer (SSL) encryption to protect your personal information from unauthorized use.

Your credit card company or your bank may not hold you responsible for an amount higher than $50 of unauthorized or otherwise fraudulent charges made to your credit card. Liability on a debit card can be greater, but check with your bank because many of them grant the same $50 limit to debit cards.

6. Limitation of Liability

We shall not be in default if delivery of SmallVerse products is delayed or rendered impossible by forces of nature, war, civil commotion, governmental action, terrorism, fire, storm, flood, explosion, strikes, walkouts, other industrial disturbances, utility, services, network or transportation interruptions, server crashes, hackers, viruses, technical glitches or any other cause beyond our reasonable control.

We may revise or modify products, product information or pricing without notice. We are not responsible for spelling mistakes, fax or printing errors.

These Terms and Conditions of Sale will be governed and interpreted pursuant to the laws of the United States, for contracts to be executed and fully performed therein and notwithstanding any principles of conflicts of law. The parties specifically disclaim application of the Convention on Contracts for the International Sale of Goods.

You specifically consent to personal jurisdiction in the United States in connection with any dispute between you and SmallVerse arising out of these Terms and Conditions of Sale or pertaining to the subject matter hereof. The parties to these Terms and Conditions of Sale each agree that the exclusive venue for any dispute between the parties arising out of these Terms and Conditions of Sale or pertaining to the subject matter thereof will be in the courts in United States.

YOU IRREVOCABLY WAIVE ALL RIGHTS TO BRING OR PARTICIPATE IN ANY CLASS ACTION SUITS OR CLAIMS REGARDING THE MATTERS RELATED HERETO AND CONSENT TO THE MANDATORY ARBITRATION PROVISIONS IN THE TERMS OF SERVICE.

If any part of these Terms and Conditions of Sale is unlawful, void or unenforceable, that part will be deemed severable and will not affect the validity and enforceability of any remaining provisions. These Terms and Conditions of Sale constitute the entire agreement among the parties relating to this subject matter. To the extent a purchase order, confirmation letter, or other communication is inconsistent with these Terms and Conditions of Sale, these Terms and Conditions of Sale will govern, unless expressly agreed in writing otherwise by an executive officer of SmallVerse (i.e., regular employees cannot bind SmallVerse).

At SmallVerse we aim to encourage creativity, social activity, and freedom of personal expression. However, we want all our citizens to gain maximum enjoyment from the game, and therefore we place some rules around behavior and content, to ensure the comfort and safety of our players.

As the game evolves over time, new situations do occur that require us to adapt or refine our rules. However, all rules are designed primarily with the well-being and protection of our players in mind, and we strive to be absolutely fair and reasonable.

2. Your Privacy

Your privacy is of the utmost importance to us here at SmallVerse. At all times we will endeavor to protect your right to privacy, and only use any personal information you submit to us, for the purpose it was originally intended for.

3. General Behavior Standards

SmallVerse expects a high standard of conduct from our players, helpers, moderators and staff at all times. We ask that all players, helpers, moderators and staff treat each other with respect and courtesy.

We expressly prohibit:

• Use of obscene, racist, or otherwise inappropriate language
• Simulation of sexual acts
• Any behavior that makes other players uncomfortable

If you encounter a player breaking these rules of conduct, please report them immediately.

4. Content Guidelines

Avatar, Space, Groups, Widget and Mission Names

SmallVerse does not condone the posting of profane, suggestive or inappropriate material to the public. We require our players to ensure that the content they publish publicly is not pornographic, hateful, profane or threatening, and that it does not break any national or international laws.

Generally if content in a private space would be acceptable in a public real-world environment for viewing by people 13 years of age and over, such as on an advertising billboard or in a normal (non-adult) magazine, we will allow it to remain.

Graffiti Board Art

All publicly-accessible content must comply with our family-friendly guidelines described above, and this includes art painted on Graffiti Boards. Images of genitalia or sexual acts are not acceptable in public spaces. Art reported as being offensive may be required to be removed from the space.

5. Trading & Scamming Prevention

The only safe way to purchase an item in SmallVerse is to click on the item. If there is a purchase button and price, then it is safe to proceed. Use the Trading Terminals (such as the ones in Trading Post) to successfully trade between players. You will each input the items/currency you agreed to and have to confirm within the terminal before the trade finalizes.

Scamming Warning: If someone asks you to give them tokens or an item, and says they will then gift you an item in return, do not do it. Frequently, this means that person is trying to scam you.

To avoid being scammed:

• Do not lend Tokens, Gold or items to anyone
• Only buy items which have a Purchase button
• Do not believe anyone who wants you to pay them first and says they will gift you the item
• Official public spaces are free to enter - anyone charging entry is scamming

If you suspect someone is trying to scam you, please report them immediately. We cannot refund losses caused by scams.

6. Security Issues

Phishing

SmallVerse will never ask you for your password! If you do get asked for your password by another player or by email, this is classed as a Phishing attack. Please report the player or email immediately.

Muling

Muling is cheating by creating multiple accounts for the sole purpose of earning Gold, Tokens or items and then transferring them to a main account.

Creating false social network/email accounts and "inviting" these "friends" for the purpose of gaining Citizen Points is also considered Muling, and is against SmallVerse rules.

7. Mission Creation Standards

SmallVerse encourages freedom and creativity when designing missions, however:

• Missions created solely for farming Tokens and XP are considered exploits
• Missions must not contain obscene or objectionable language/material
• Missions must not promote spamming

8. Community Behavior

Begging

Begging is not specifically against SmallVerse rules, however if a person begs by repeating the same phrase over and over, this is considered spamming. Generally, we encourage players not to beg for Tokens or Gold.

Spamming

Spamming is repeating the same word or phrase over and over. If you encounter someone who is spamming, please report them.

Harassment

Harassment in any form ruins the enjoyment of the game for others. We investigate and treat seriously any reports of racial, sexual, religious or ethnic harassment, or any kind of verbal attack against a player.

If you are being harassed, please report the player and then block them.

Magic Attacks

While magic fights are part of normal gameplay, repeatedly using magic on a player who has asked you to stop is considered harassment. New players are particularly vulnerable to magic harassment by more experienced players.

9. Forum & Event Standards

Forums

In the SmallVerse forums we require high standards of courtesy and respect. We do not allow:

• Posting other players' personal information
• Offensive or inappropriate material
• Naming/shaming other players

Events (Alerts)

In-world alerts should not contain profane or offensive language or statements. We do not allow alerts which advertise or promote sexual acts.

10. Purchases & Account Actions

By purchasing goods or services through SmallVerse, you acknowledge and accept our Terms of Sale. By using the SmallVerse service, you explicitly agree to the Terms of Service.

Enforcement Actions

SmallVerse reserves the right to cancel accounts and ban users at any time, for any reason. We take great care to only ban people for the protection of the community.

Our enforcement process typically includes:

• Warnings or temporary removal for first offenses
• Temporary or permanent bans for repeat offenses
• Immediate action for serious offenses like Phishing and Scamming

Fraudulent Chargebacks

A fraudulent chargeback occurs when someone purchases products, receives these products in good order and then lays a false complaint with their credit card company. The credit card company issues a "chargeback" where they reverse the payment pending the outcome of any resulting dispute.

SmallVerse takes fraudulent chargebacks very seriously and all cases will be disputed and the offender prosecuted to the maximum extent of the law. Our fraud prevention systems share information on fraudulent transactions and reduce the likelihood that misused cards will be accepted by other merchants. SmallVerse uses CVV2 to validate your credit card and your IP address and network host are recorded when your order is placed. This information will be used to trace the order to the person(s) placing the order.

All information on fraudulent accounts and cards will be turned over to the authorities to assist in locating and prosecuting any and all guilty parties. Offenders may be subject to fines and imprisonment.

Muling is Cheating

"Muling" is cheating by creating multiple accounts to earn and transfer tokens and/or gold by repeatedly completing the basic missions and tasks - then transferring tokens, gold, and items to their original main account(s).

Why is this cheating?

This practice is unfair on other players who put real time and effort into building the income, experience and unique personality of their avatars. Players who practice muling instead use repetitive unskilled methods to unfairly gain wealth for their main avatars without truly contributing to the culture or gameplay of SmallVerse.

How does SmallVerse catch Mulers?

We have several tools that help up automatically detect Muling, there are many tell-tale signs and sooner or later, all Mulers are discovered.

What happens with Mulers?

First-time offenders will receive an instant ban of all mule accounts and may have the unfairly gained Tokens, Gold, and Items removed from their main accounts. They will be notified in writing and if they feel they have been unfairly treated they can appeal in writing to our support team and their case will be considered. In most cases Muling is very obvious and arguments such as "my sister did it" will not be accepted as the user is responsible for the operation of their account.

Repeat offenders will receive an instant ban of all accounts, including their main account(s).

These practices are NOT Muling:

Having multiple accounts
While SmallVerse doesn't encourage multiple accounts, we don't prohibit it either. The best way to decide if it is Muling or not is this: Do you use your other accounts for actual gameplay, have you spent time making friends, creating their space - do you value the avatars on this account? If so, this is a genuine account. If you just create and use this account to farm tokens, gold, and items for a different account, then it's Muling. It's easy for us to tell the difference.

Having multiple avatars
SmallVerse allows up to 3 avatars on each account, these share the same inventory and Token/Gold balances.

Transferring tokens, gold, or gifting items between genuine accounts
Transferring and gifting between real accounts is a normal practice. The key thing is, are the accounts used for genuine gameplay, or was one of them used to simply farm tokens, gold, or items?

Selling Items for Real Money (Scam Warning)

If you see any player attempt to sell items to another player for real money e.g. "If you credit my PayPal account with $5 I'll gift you the Oaken Chair" please report them!

This is a very dangerous practice that is causing real loss for unsuspecting people. A similar scam is the "if you buy Gold for me I'll do x, y or z for you".

Never accept an offer like this from another player - there is no way to be sure that they will not just keep your money - it's a classic scam. Besides, it's almost always better value to earn or buy some Gold and purchase the item from SmallVerse or another player using the proper buy/sell process.

SmallVerse will instantly ban any player who takes part in a transaction like this - this includes both buyers and sellers.

Never share your personal information (such as PayPal account email addresses etc.) with other players.

SmallVerse cannot accept responsibility or compensate people in any way for any loss they may have suffered for taking part in this practice. Always report players who take part in scamming.

Important Notes

Sometimes a Mod or Helper may be stationed to assist within a specific room and may not be able to leave the space, so if you ask them to follow you somewhere they may not be able to. The SmallVerse Help Center is usually a great place to find a Helper.

The SmallVerse Helper programme needs you! We are on the lookout for great people to come and be SmallVerse helpers. Helpers help others in the game, answer questions, and help with missions.
